Terms of Service

1. Acceptance of Terms

By accessing or using I Sell My Property, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to comply with these Terms. If you are using the Platform on behalf of a business or agency, you represent that you have the authority to bind that entity to these Terms.

We reserve the right to update these Terms at any time. We will notify registered users of material changes via email. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.

2. Definitions

• "Platform" means the I Sell My Property website, mobile applications, and all related services.
• "User" means any person who accesses or uses the Platform, including Property Seekers, Property Owners, and Licensed Agents.
• "Property Seeker" means a User who searches for properties to buy or rent.
• "Property Owner" means a User who lists a property for sale or rent on the Platform.
• "Licensed Agent" means a real estate agent holding a valid licence in their respective Australian state or territory who uses the Platform.
• "Listing" means a property advertisement published on the Platform.
• "Package" means a paid service tier purchased by a Property Owner or Licensed Agent to list a property.

3. User Accounts and Registration

• You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials.
• You must verify your email address and phone number to activate your account. No document verification is required.
• You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.
• We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
• Users may register as a Property Seeker (Buyer or Renter), Property Owner (Seller or Landlord), or Licensed Agent. Each role has different permissions and responsibilities.

4. Property Listings

4.1 Listing Creation

• Property owners may list properties for sale or rent by completing our 10-step listing wizard and purchasing a package.
• Each package purchase entitles you to one (1) property listing. Additional listings require separate package purchases.
• You must be the legal owner of the property or have authorisation from the owner to list the property.

4.2 Listing Responsibility

By submitting a listing, you acknowledge that you are solely responsible for the accuracy, completeness, and legality of all listing content. ISellMyProperty does not verify or endorse any listing content. Listings go live immediately upon submission. We reserve the right to remove listings that contain inaccurate information, misleading content, or that otherwise violate these Terms or applicable law.

4.3 Listing Duration

• For Sale listings run until the property is sold and the owner removes the listing. There is no expiry date.
• Rental listings run for the period covered by the selected rental package.
• Owners are responsible for removing listings once a property has been sold or leased.

4.4 Listing Content

• All listing content must be accurate, truthful, and not misleading. You must comply with all applicable Australian Consumer Law and state/territory fair trading legislation.
• You retain ownership of the content you upload (photos, descriptions, documents) but grant us a non-exclusive, worldwide licence to use, display, and distribute that content for the purpose of operating the Platform and syndication to partner portals.
• We may edit or remove content that violates our policies.

5. Packages and Payments

5.1 Sale Packages

We offer four sale listing packages at the following price points (all amounts in AUD, inclusive of GST):

• Essential: $189
• Basic: $449
• Ultimate: $899
• Premium: $1,899

5.2 Rental Packages

Rental listing packages are available at the following price points (all amounts in AUD, inclusive of GST):

• Basic: $99
• Featured: $149

5.3 Add-Ons

Optional add-on services (photography, drone shots, virtual tours, etc.) may be purchased alongside your package. Add-on prices are displayed at checkout.

5.4 Payment Processing

• All payments are processed securely through PayPal. By making a payment, you also agree to PayPal's terms of service.
• Prices may be changed at any time but will not affect existing paid orders.

5.5 Refunds

Refund requests are assessed on a case-by-case basis. If your listing has not yet been published, you may be eligible for a full refund. Once a listing is live, refunds will only be provided in exceptional circumstances at our discretion. Professional services already rendered (photography, copywriting, etc.) are non-refundable.

6. User Obligations

When using the Platform, you agree to:

• Provide accurate, complete, and up-to-date information in your listings and profile
• Not create fraudulent, misleading, or deceptive listings
• Not use the Platform for any unlawful purpose or in violation of any applicable laws
• Not harass, abuse, or send unsolicited communications to other users
• Not scrape, harvest, or collect data from the Platform without our written consent
• Not attempt to gain unauthorised access to any part of the Platform or its systems
• Comply with all applicable Australian real estate legislation, including pricing compliance and anti-money laundering obligations
• Remove your listing promptly once a property has been sold or leased

7. Licensed Agents

If you register as a Licensed Agent, you additionally represent and warrant that:

• You hold a current and valid real estate licence in the relevant Australian state or territory
• You have authority from property owners to list their properties on the Platform
• You will comply with all applicable professional conduct obligations and industry codes

8. Intellectual Property

• All content, branding, logos, design, code, and other intellectual property associated with the I Sell My Property platform is owned by I Sell My Property Pty Ltd and is protected by Australian and international intellectual property laws.
• You may not copy, reproduce, distribute, or create derivative works of any part of the Platform without our prior written consent.
• User-generated content (listing photos, descriptions, etc.) remains your property, subject to the licence granted in Section 4.4.

9. Privacy

Your use of the Platform is governed by our Privacy Policy, which outlines how we collect, use, store, and disclose your personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

Property Owners may choose to hide their phone number from public view on their listings. Enquiries will still be delivered via the Platform's messaging system and email notifications.

10. Limitation of Liability

• The Platform is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by Australian law.
• We do not guarantee the accuracy of property listings, user-provided information, or median price data displayed on the Platform.
• We are not a party to any real estate transaction and do not provide real estate, legal, financial, or investment advice.
• To the maximum extent permitted by law, our total liability for any claim arising out of or in connection with the Platform is limited to the amount you have paid us in the 12 months preceding the claim.
• We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform.
• Nothing in these Terms excludes or limits any consumer guarantee under the Australian Consumer Law that cannot be excluded or limited.

11. Termination

• You may close your account at any time by contacting our support team. Active listings will be removed upon account closure.
• We may suspend or terminate your account at any time if you breach these Terms, engage in fraudulent activity, or if continued access poses a risk to the Platform or other users.
• Upon termination, your right to use the Platform ceases immediately. Provisions relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and any courts of appeal from them.
